Designs

Designing a product, a package, a pattern or an interface? Its appearance sets your products apart from those of your competitors. We advise on the protection, management, licensing and defense of your designs, in France and internationally.

Planning ahead for the protection of your creations preserves their value.

Discuss your design

What is a design?

A design protects the visual appearance of a product: its shape, lines, colors, texture, materials or ornamentation. The product may be an industrial product, packaging, a logo, a textile pattern or a graphical user interface.

In France and in the European Union, a registered design may benefit from protection that is renewable in five-year periods, up to a maximum of twenty-five years, subject to the applicable legal conditions. Protection takes effect from the filing date.

INPI · France EUIPO · Europe WIPO · International

"Filing makes it possible to organize and strengthen the protection of a product's appearance. Whether it is worthwhile must be assessed in light of the creation, its disclosure and the markets concerned."

Which creations can be protected? Protection requires, among other conditions, that the design meet the requirements of novelty and individual character.

Managing, licensing and enforcing your designs

Your products, packaging and collections change; their protection has to keep up. We identify what is worth filing, prioritize between designs and plan successive filings in France, in the European Union and internationally.

We take over and manage design portfolios: monitoring of rights, renewals, recordals, and audits of the rights to maintain or abandon. We negotiate and draft the licenses and assignments under which they are used.

When a design is copied, we assess the scope of your rights, seek an amicable solution and, where court action is required, work in coordination with the litigation counsel (avocats) in charge of the proceedings.

Designs — the essentials

The most frequently asked questions, with direct answers.

What is the difference between a design and a trademark?
A trademark protects a distinctive sign that identifies the commercial origin of a product or service. A design protects the aesthetic appearance of a product, irrespective of its function. The two rights are complementary: a logo can be protected both as a trademark and as a design.
How do I file a design in France?
The application is filed with the INPI (French IP Office). You must provide a graphic representation (photograph or technical drawing), indicate the products concerned according to the Locarno Classification, and pay the official fees. The application may be single or multiple (up to 100 designs in one application).
Can a design be protected throughout Europe?
Filing an EU design with the EUIPO makes it possible to seek protection in all the Member States. There is also, subject to certain conditions, protection for unregistered EU designs, lasting three years from the date on which they were first made available to the public, under the conditions laid down in the applicable legislation.
Should I file before presenting my product in public?
As a rule, yes. Novelty is a condition of protection. We recommend filing before any commercial launch, trade show or publication on social media. Some systems provide a twelve-month grace period for certain specified disclosures. This mechanism should not, however, be regarded as a general safeguard, particularly in an international strategy.
